These terms should be read in conjunction with our Website Terms and Community Guidelines. When we mention “we” or “us” in these terms, we are referring to Decibel and our affiliated companies, subsidiaries, and each entity’s officers, directors, agents, partners, and employees.
1. We Are Not the Event Organizer
Third-party event organizers and service providers use the Decibel platform to advertise their events, booking services, corporate functions, and similar offerings. When you purchase tickets for an event or service, or RSVP to an event, your agreement is with the event organizers or service providers, not Decibel. We do not validate the legitimacy of the events or services, nor do we verify the accuracy of any information or descriptions provided by the organizers. Prices and refund policies are determined by the event organizers and service providers, who are solely responsible for delivering the event, products, or services.
Events, bookings, and corporate functions may have specific terms and conditions set by the event organizers and service providers. It is your responsibility to read and understand these terms before purchasing a ticket, making a booking, or RSVPing. We are not liable for any cancellation, postponement, limitation, or restriction of an event or service. Any disputes or complaints regarding an event or service should be directed to the event organizers or service providers unless the issue concerns our checkout platform or process. We may, at our sole discretion, choose to mediate disputes or complaints in certain circumstances.
2. Payments
Payments made through our platform are considered to be made by the owner of the Decibel account used, not necessarily by the owner of the credit card or bank account used for payment.
Creating an account and accessing the platform is free, but we charge fees when processing payments. These fees may vary based on individual agreements between event organizers and Decibel. Typically, our fees include a percentage-based fee (“Commission”). Event organizers determine whether these fees will be charged to consumers, shown as additional fees on the booking page, or absorbed into the ticket price.
Our fees may change over time and can vary based on factors such as product type, price, and payment method. Current fees can be found on the Decibel website under the relevant product section. The Commission Fee is non-refundable in all cases and is charged for using our platform, regardless of any cancellation by the event organizers.
A payment is not confirmed until we receive it in full. If full payment is not received, we will notify you of the unsuccessful payment. Only payment methods specified at checkout by our payment partners are accepted. We do not store bank card details on our servers; these are stored by the payment providers.
If you pay via electronic funds transfer, you must send us proof of payment, including the correct bank account details, payment amount, and reference number. All fee amounts indicated on the booking and checkout page include value-added tax.
If a charge-back claim arises, it is your responsibility to provide the event organizers with all necessary documentation to resolve the claim. If we suspect a transaction is fraudulent, we may request proof of identification, address, or other details to confirm the transaction’s validity.
3. Refunds
All refunds will first be credited to your Decibel Wallet, minus any bank and commission fees already deducted. From your wallet, you can request a refund to your bank account or use the funds to purchase other tickets or products on the Decibel platform.
For refunds to your bank account, the following terms apply: All transactions are between you and the event organizers or service providers. You must contact them directly for refund requests. The availability of a refund depends on the event organizer’s or service provider’s refund policy, which is communicated during the ticket purchase process. We do not establish or control these refund policies.
Refunds will exclude our fees, and you are responsible for any bank charges associated with processing the refund. Where applicable, you authorize us to refund the amount to the same account used for the initial payment. If an event is canceled, or we believe there is a risk of cancellation or non-performance, and we facilitated the transaction through one of Decibel’s payment processing partners, we will initiate a refund of the transaction amount, minus our fee. Decibel must be able to successfully complete the refund to your payment card account; if your card-issuing bank declines the refund, we may not be able to process it.
If payment was made via electronic funds transfer or another method that cannot be automatically refunded, we will request your bank details in writing to process the refund. We cannot issue a refund without these details, and after three years, you will lose the right to a refund permanently.
In some cases, ticket proceeds are held by the event organizers, not by us. This will be communicated during checkout. In such instances, you must contact the organizer directly for a refund. We are not responsible for processing refunds when we do not hold the ticket proceeds.
4. Events
Certain events may not be suitable for younger attendees, and age restrictions are determined by the event organizers. If you purchase a ticket for an age-restricted event, you must ensure that no one outside the specified age group attends.
Before purchasing tickets for a virtual event, you must confirm that you have the necessary equipment, including a suitable device and internet access with sufficient bandwidth, to participate. Tickets are sent to you via email, and you must present a copy to access the event. We will not replace lost, destroyed, or stolen tickets. Neither Decibel nor the event organizers are responsible if a third party gains access to an event due to your failure to secure your ticket or Decibel account details.
5. Reviews
Decibel may allow users to leave reviews for events, booking services, or organizers. These reviews may be shared with the event organizers, who may use them in their media or promotions. Reviews may be publicly displayed on our site and will show your name unless you choose to post anonymously.
Reviews that violate our Website Terms and Community Guidelines may be removed, and we reserve the right to remove reviews for any other reason at our discretion.
6. Disclaimer and Assumption of Risks by You
Certain circumstances are beyond our control, and we cannot guarantee specific outcomes. Decibel sends tickets and transactional updates via email to the address provided by the person placing the order. Emails may not be delivered due to various issues such as incorrect email addresses, upstream provider problems, or issues with the recipient’s mailbox (e.g., full inbox, firewalls, or emails being filtered into junk or promo folders). Decibel is not responsible for the non-delivery of emails but ensures that your tickets are stored in your Decibel account for easy access at any time.
Decibel does not guarantee that any event or booking service will meet your expectations, be safe, secure, uninterrupted, or error-free. Decibel has no control over and does not guarantee the quality, safety, accuracy, or legality of any event or content associated with an event, subscription, or fundraiser. We accept no responsibility and disclaim all liability for the actions or omissions of any third parties.
There are risks associated with attending physical events, and by choosing to attend, you voluntarily assume these risks. These risks include, but are not limited to, property damage, personal injury, illness, disability, or death.
Certain events may present increased risks. For example, attending a music festival could result in hearing loss, seizures, or other injuries and health conditions due to loud sounds, large crowds, and special effects like flashing lights, laser projections, and fireworks.
By attending an event, you accept all risks associated with it.
