These Terms of Use govern access to and use of the Decibel Event Solutions platform, including our website, mobile applications, APIs and support channels. By using our services you agree to these terms, the Privacy Policy, POPIA Compliance Statement and Cookie Policy.

1. Definitions
"Decibel", "we", "us" or "our" refers to Decibel Event Solutions (Pty) Ltd, a private company incorporated in the Republic of South Africa. "Services" means our event discovery, ticketing, hosting and related digital offerings. "User" or "you" refers to any person accessing or using the services, including ticket buyers and event hosts. Additional definitions appear in context within these terms.
2. Eligibility and Account Security
To create an account you must be at least 18 years old and have the legal capacity to enter into binding agreements. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. Notify us immediately at [email protected] if you suspect unauthorised access or misuse.
We may suspend or terminate your account if we reasonably believe that you have breached these terms, violated applicable law, or compromised the security or integrity of the services.
3. Hosting and Ticket Purchases
Hosts are responsible for the accuracy of event listings, compliance with venue and regulatory requirements, and the safe delivery of events. Ticket purchasers agree to comply with event-specific conditions of entry, including age restrictions, prohibited items and venue policies.
All transactions processed through Decibel are subject to payment verification, fraud screening, and anti-money laundering controls. Pricing, taxes and applicable service fees are displayed prior to checkout.
4. Fees
We charge service fees for certain transactions. Fees may differ based on event type, payment method or territory and will be disclosed before you confirm a booking. Hosts authorise us to deduct applicable fees from ticket revenue prior to settlement.
5. Ticket Purchases, Cancellations and Refunds
1. General No-Refund Policy
1.1. All tickets purchased through the Decibel ticketing platform (“Platform”) are non-refundable and non-transferable, except as expressly provided in these Terms and Conditions, the applicable event organiser’s refund policy, or as required by applicable law.
1.2. Once a ticket purchase has been completed, a purchaser is not entitled to a refund merely because they have changed their mind, can no longer attend, are unavailable on the event date, have made an incorrect booking, or have experienced a change in personal circumstances.
1.3. An inability to attend an event, for any reason, does not in itself constitute grounds for a refund. Purchasers are responsible for ensuring that they can attend the event before completing their purchase.
2. Event Cancellation
2.1. If an event is cancelled, postponed or materially changed, the applicable refund arrangements will be determined with reference to the event organiser’s published terms and conditions, the event-specific refund policy and applicable law.
2.2. Where an event is cancelled and the event organiser has not expressly stipulated that tickets are non-refundable in the event of cancellation, Decibel will refund the purchaser the amount paid for the ticket, less any applicable ticketing, booking, payment processing, gateway or other transaction fees, to the extent that such deductions are permitted by applicable law.
2.3. Where the event organiser has expressly stipulated, before purchase, that tickets are non-refundable in the event of cancellation, that policy will apply only to the extent that it is lawful and enforceable under applicable law.
2.4. Where a refund is approved or required, the refund will be processed using the original payment method wherever reasonably practicable. Processing times may depend on the relevant payment service provider or financial institution.
2.5. Decibel acts as a ticketing service provider and is not necessarily the event organiser. Responsibility for refunds may depend on the circumstances of the cancellation, the event organiser’s obligations, the funds received and retained, and applicable law. Nothing in this clause excludes any refund obligation that legally rests with Decibel or the event organiser.
3. Postponed or Rescheduled Events
3.1. Where an event is postponed or rescheduled rather than cancelled, tickets will generally remain valid for the rescheduled event, subject to the event organiser’s published policy and applicable law.
3.2. A purchaser’s inability to attend a rescheduled event does not automatically entitle the purchaser to a refund, except where required by applicable law or expressly provided in the applicable event policy.
4. Statutory Rights
4.1. Nothing in these Terms and Conditions is intended to exclude, restrict or waive any rights that a purchaser may have under applicable consumer protection legislation or other mandatory laws.
4.2. Where applicable law requires a refund or prohibits the deduction of particular fees, the relevant legal requirements will prevail over any conflicting provision of these Terms and Conditions.
5. Refund Administration
5.1. Purchasers must submit refund requests through the contact or support channels specified on the Platform.
5.2. Decibel may request reasonable supporting information to verify a refund request and determine the applicable event policy.
5.3. Any refund will be limited to the amount properly refundable under the applicable event policy and law. No refund will be made for an amount that is lawfully non-refundable under the applicable terms.
6. Acceptable Use
You agree not to misuse the services, including by interfering with security features, attempting to gain unauthorised access, introducing malware, scraping data without consent, or using the services for unlawful, harmful or deceptive purposes. We reserve the right to investigate and refer any suspected illegal activity to the appropriate authorities.
7. Intellectual Property
All intellectual property rights in the services, including software, databases, trademarks, logos, content and design elements, are owned by or licensed to Decibel. You may not reproduce, distribute, modify, or create derivative works from our intellectual property without prior written consent. Hosts grant Decibel a non-exclusive, royalty-free licence to use event content for the purpose of providing and promoting the services.
8. Data Protection
Processing of personal information is governed by our Privacy Policy, POPIA Compliance Statement and Cookie Policy. By using the services you acknowledge that you have reviewed these documents and understand how we collect, use and share personal information.
9. Disclaimers and Liability
The services are provided on an "as is" and "as available" basis. To the maximum extent permitted by South African law, we disclaim all warranties not expressly stated in these terms. Decibel does not guarantee uninterrupted access, error-free operation, or the accuracy of third-party content.
Neither Decibel nor its directors, employees or agents will be liable for any indirect, consequential, special or punitive damages arising from or related to the use of the services. Our total liability for direct damages will not exceed the greater of R1,000 or the total fees paid by you to Decibel in the 12 months preceding the claim, unless otherwise required by law.
10. Indemnity
You agree to indemnify and hold Decibel harmless against any claims, damages, losses, liabilities, costs and expenses arising out of your breach of these terms, violation of law, or infringement of third-party rights in connection with your use of the services.
11. Termination
We may terminate or suspend access to the services at any time on reasonable notice, or immediately where you materially breach these terms or applicable law. You may close your account at any time through your profile settings or by contacting support. Sections that by their nature should survive termination will remain in effect, including intellectual property, liability, indemnity and dispute resolution provisions.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of the Republic of South Africa. If a dispute arises, the parties will first attempt to resolve it amicably through good-faith negotiations. If unresolved within 20 business days, the dispute may be referred to confidential mediation under the rules of the Arbitration Foundation of Southern Africa. Nothing prevents either party from seeking urgent interim relief in a court of competent jurisdiction.
13. Changes to These Terms
We may update these Terms of Use from time to time. Material changes will be communicated via email or prominent platform notices at least 14 days before they take effect unless immediate changes are required to comply with law. Continued use of the services after updates become effective constitutes acceptance of the revised terms.
